Sonam gets bail due to police procedural lapse

Shillong, April 28: Sonam Raghuvanshi, the prime accused in the murder of Raja Raghuvanshi case, secured bail.

A hearing on the case was held last week and order of the sessions court was made on Monday (April 27)

The reason for the bail is that the police have not explained the reason why she was arrested as per article 22 of the Constitution.

The special public prosecutor Advocate KC Gautam has confirmed the bail granted to Sonam due to procedural lapse while arresting Sonam.

The reason for arresting her was not communicated by the police, he said.

The Article 22 (1) of the Constitution states about protection against arrest and detention in certain cases. “No person who is arrested shall be detained in custody without being informed, as soon as may be, of the grounds for such arrest nor shall he be denied the right to consult, and to be defended by, a legal practitioner of his choice”, it says.

The petitioner was also not informed about the offence u/s 103(1) of BNS.
