Activist petitions ECI for fresh poll in Williamnagar

Shillong, ,March 24: Activist Tennydard Marak has petitioned Election Commission of India  to declare Williamnagar election null and void and to hold fresh poll.

Citing several cases of violation of model code of conduct by Williamnagar representative Marcuise Marak , Tennydard said strictest action should be taken against him and ‘punish him by declaring his election to be void for adopting corrupt practice and hence hold fresh election and if no action is initiated by you then there is absolutely no use of formulating the model code of conduct.It  seems the model  code conduct is only for show and has no impact /application in reality and therefore nobody bothers’.

Ref: Application of Model Code of Conduct – General Elections to State Legislative Assemblies of Meghalaya, Nagaland and Tripura, 2023 and Bye-elections in Parliamentary /Assembly Constituencies of various States – reg vide Notification No.437/6/1/ ECI/ INST/ MCC / 2023 dated 18th January, 2023.

Subject: Complaint in respect of -Misleading Advertisements – objectionable Advertisements – misguiding the Voter by none other than Mr. Marcuise N Marak and his Party i.e., National Peoples Party (NPP).

Respected Sir,

I would like to state that the election campaigns are conducted to have a free and open discussion about who is a better representative and in turn which party will make a better Government. In Meghalaya a Notification was issued vide Notification No.437/6/1/ ECI/INST/MCC/2023 dated 18th January, 2023, whereby Application of Model Code of Conduct – General Elections to State Legislative Assemblies of Meghalaya, Nagaland and Tripura, 2023 and Bye-elections in Parliamentary /Assembly Constituencies of various States was imposed.

It is therefore expected that all parties and candidates shall avoid scrupulously all activities which are “Corrupt Practices” and offences under the election law, such as bribing of voters, intimidation of voters, impersonating of voters etc. etc.

That Sir, I would like to draw your kind notice to the activities of the ruling party namely, “National Peoples Party (NPP)” and the Chief Whip of the Govt. of Meghalaya and its M.L.A, of 43, Williamnagar Mr. Marcuise N. Marak, Hon’ble Chief Whip of Govt. of Meghalaya has circulated a “Report Card 2018-22” during the election campaign which contains false claims and completely fabricated report of his so-called achievements in order to woo the voters of Williamnagar and was successful in his mission and got elected on the basis Report Card 2018-22 and now a Minister in the Conrad Sangma Ministry. I am enclosing the copy of the “Report Card 2018-22”, which will expose the nature of the developmental progress along with the true pictures of his actual status of the works and has thereby misused the official power and the confidence of the Party.

It is worth mentioning here that the “Report Card 2018-22” was published by Shri Jerubell Ch. Marak (Block Secretary NPP, 43 – Williamnagar Constituency) Date of publication 3rd February, 2023 No of copies -4000 .

The highlights of the “Report Card 2018-22” are as follows:

It was distributed by Marcuise N. Marak, the Hon’ble Chief Whip of Govt. of Meghalaya which is in strict violation of Model Code of conduct which is in fact effective from 18th January, 2023 and the “Report Card 2018-22” was published on 3rd February, 2023 during the period of Model Code of conduct.

It contains only the works done during the period 2018-2022 and the credit claimed by him whereas it is completely a fabricated and false report and mostly half completed works.

There is deliberate misuse of official power.

The report contains nothing about the plans & work for the next session of future 5 years.

Whereas all parties and candidates shall avoid “corrupt practices” and offences under the election law, such as bribing the voters, intimidation of voters, impersonating of voters etc., etc.

Section 171 F: Punishment for undue influence or personation at an election. Whoever commits the offence of undue influence or personation shall be punished with imprisonment of either description for a term which may extend to one year or fine or with both.

Under Education Sector:

In the “Report Card 2018-22” circulated by the M.L.A. of 43, Williamnagar Mr. Marcuise N. Marak, Hon’ble Chief Whip of Govt. of Meghalaya under Education Sector under Sl. No. 5. Girls School (Beautification) Cinema Hall. He has made a blatant false claim to have done beautification of the Girl’s School but in fact he has done nothing. The following picture will speak the truth of his report.

There is no Gate of the Williamnagar Girls Sec School which is a must for a Girls School or any School.

There is no concrete wall in the boundary of the school, the boundary wall is covered with rusted C.I. Tin Sheets.

Now, what is the definition of beautification. What happened to the money allotted for beautification and why this false claim is made about the school which is in the heart of the town Williamnagar and mockery with the voter of Williamnagar.

In the “Report Card 2018-22” circulated by the M.L.A. of 43, Williamnagar Mr. Marcuise N. Marak, Hon’ble Chief Whip of Govt. of Meghalaya under Education Sector under Sl. No. 7. New School Building (Jakopgre for example). I am giving one example where no new school building was ever constructed but in the Report Card of the Hon’ble MLA of 43, Williamnagar Assembly Constituency Mr. Marcuise N. Marak, Hon’ble Chief Whip of Govt. of Meghalaya has officially claimed to have constructed New School Building. The Photo given below of the School of Jakopgre will speak for itself.

Under Eco Tourism Sector:

The “Report Card 2018-22” circulated by the M.L.A. of 43, Williamnagar Mr. Marcuise N. Marak, Hon’ble Chief Whip of Govt. of Meghalaya, who has claimed to have completed the buildings costing to Rs. 14 crore spent on the construction of Tourist Houses at places to as many as Mandalgre, Rapdikgre, Jakopgre, Ampanggre , Bawegre, Nengmandalgre , Bolkingre & Mrik wari. I have inspected one in Jakopgre and the status of the said building is placed below for your kind perusal and I am sure you will agree that whatever claim is made in the Report Card is nothing but a false and fabricated claim.

Under Road Sector: 

Sl. No. 7 (a) PMGSY: Nengmandalgre ONI Mandalgre (35 Km) (80 Crores): I visited the construction site of the Road Nengmandalgre ONI Mandalgre (35 Km) and surprised to see that the work is purely sub-standard category and not even completed, after about 15 Km from the starting point the remaining work of the road is not done up to the mark. If an enquiry is ordered immediately, the truth of my report will come to light. This work is done under Prime Ministers Gram Sadak Yajna and his contribution in it is Nil.

Moreover, releasing of Video Clip for political advantage during recently concluded Meghalaya Assembly Election, 2023 insulting, hurting as well as provocating the religious sentiments by the Members of National Peoples Party (NPP). Although the matter has been brought to the Notice of the authorities concerned by filing two FIR one at Tura by one Mr John Lesee K. Sangma, a member of Baptist Church, Tura in connection with a video which has gone viral where the Members of National People’s Party led by Georgeman Marak, claimed to be the General Secretary of the National People’s Party, Williamnagar is not only hurting the religious sentiments of the people and one by me at Williamnagar Police Station. I am forwarding herewith video Clips (a) Speech of Marcuise N. Marak and (b) Video of Georgeman Marak for your ready reference, which will speak for itself.

Under the above facts and circumstances, my humble submission before you are that kindly to initiate a strictest action and punish the guilty by declaring his election to be void for adopting corrupt practice and hence holding fresh election and if no action is initiated by you then there is absolutely no use of formulating the Model Code of Conduct which it seems these Model Code of Conduct are only for show and has no impact / application in reality and therefore nobody bothers.

It is therefore expected that immediate proper action may be initiated from your end on the basis of prima facie evidence placed before you but in-spite of the prima facie evidence, if no action is initiated then I will be left with no other alternative but to approach the Court of law for redressal of my genuine grievances.
