Model code violation complaint against police and customs officers in GH

Shillong, April 6: Social Activist Nilberth Ch. Marak has lodged a complaint with Election Commission of India against North Garo Hills SP Bruno Sangma and Gasuapara customs officer for alleged violation of model of conduct.

Subject: – Complaint against Shri. Bruno A. Sangma, Superintendent of Police, Resubelpara North Garo Hills District Meghalaya and against the Custom Officer of Gasuapara South Garo Hills Meghalaya for inviting the Chief Minister of Meghalaya and others and for indulging in illegal exportation of goods to neighboring countries of Bangladesh after the announcement of the code of conduct dated.16.03.2024 for upcoming General election to the Lok Sabha Election 2024, which amount to the gross violation of the code of conduct announced by Assistant Chief Electoral Officer Govt. of India.

Respected Sir,

With reference to the subject cited above, I have the honor to state the following for your kind information and necessary action as follows:-
That the people of Garo Hills had been witnessing that illegal transportation of goods like Sugar, Onion, Betel nuts and other eatable foods had been illegally being export/transported to the neighboring countries of Bangladesh without availing the proper document and permission from the competent authority, which is required as per various provision of law. It is stated that thousands of trucks in a week and other vehicles had been illegally transporting/exporting the sugar, onions to the Bangladesh without proper license or without proper permission from the competent authority or from the concerned Department. This illegal exportation and transportation of above mentioned goods had been going on since from the month of January 2024 till date.
That the public at large had been lodging their verbal complaint to Shri. Bruno A. Sangma, Superintendent of Police, Resubelpara North Garo Hills District Meghalaya and requesting him to conduct the inquiry and also to check the trucks and vehicles carrying sugar, onions, betel nuts and other eatable goods exporting to Bangladesh to ascertain and verify whether the goods carrying and transporting to neighboring Bangladeshi are having proper document or having the proper license or permission to export to the foreign countries like Bangladesh, but the concerned SP have ignored the matter and have not responded to the complaint lodged by the general public. It is further stated that the Resubelpara North Garo Hills is situated at the border between Assam and Meghalaya and it is also the entry road to enter into Meghalaya from Assam, Therefore, the Resubelpara is the entry and exist point whereby the police Department or Custom Officers can check the illegal exportation and illegal importing of goods however, the above mentioned SP had been allowing the ongoing illegal exportation of goods to pass through his jurisdiction and to travel throughout the entire Garo Hills and allowing to enter to the Bangladesh through South Garo Hills Gasuapara border between Meghalaya(India) and Bangladesh.
That section 11(1) of the Custom Act, 1962 have prohibit the import or exportof goods to the other foreign countries to maintain the security of the nation, to maintain the public order and standard of decency or morality, to prevent the smuggling of contravention and to prevent serious injury to domestic production of good of any description etc, but surprisingly both the custom Department and the SP of North Garo Hills had been allowing the illegal exporting of goods like sugar onions and other to Bangladesh.
It is also stated that the Chief Election commission of India has announced and declared the schedule for General Election to the Lok Sabha 2024 and the Model code of conduct is being implemented from the date of the announcement of schedule for general election i.e. with effect from 16.03.2024, however it is learnt from the reliable source that the above mentioned SP have invited the Chief Minister and others to his personal residence which amounts to Election meeting and such act of the SP amounts to violation of the Model code of conduct declare by the Chief Election Commission of India on 16.03.2024.
That the Para-3 (1)(a) of the letter dated.16.03.2024 issued by Senior Principal Secretary from the Office of the Chief Election Commission of India where it is stated that “The Ministers shall not combine their Official visit with electioneering work and shall not also make use of Official Machinery or personnel during the electioneering work”,
That Shri. Bruno A. Sangma SP of North Garo Hills is the family member and close relative of present Chief Minister of Meghalaya Shri. Conrad K.Sangma as the SP also is the husband of the younger sister of the husband of MP Agatha A. Sangma and moreover Karkutta under North Garo Hills is the Hometown of SP Shri. Burno A. Sangma’s wife and native place of Shri. Bruno A. Sangma therefore, as a police Officer he can influence the voters and indirectly campaign in favour of NPP Candidate Madam Agatha K. Sangma, therefore Shri. Bruno A. Sangma should be immediately transferred from Resubelpara to some other District of Garo Hills and further pray to take action against the above mentioned erring officers as per the law.
That in view of the above fact and circumstances of the case the undersigned humbly prays to take the matter seriously with the concerned authority and to take the appropriate action against the above mentioned officers i.e. the SP of North Garo Hills and Custom Officers of Gasuapara South Garo Hills District Meghalaya under the provision of law.
