SC wants HC to rehear petition to order CBI probe into cop’s mysterious death

Shillong, May 8: The Supreme Court has sent back the petition for CBI probe into the mysterious death of former officer in-charge of Patharkhmah outpost PJ Marbaniang to the High Court of Meghalaya.

It was a day after he detained 32 illegal coal-laden trucks on January 24, 2015 that Marbaniang was found dead with bullet injuries on his head inside his official residence at Patharkhmah.

The NGT had banned illegal coal mining and transportation in April 2014.

Though the mother of the police officer petitioned the high court of Meghalaya for a CBI probe, the government instituted an inquiry by a special investigation team (SIT) headed by then city SP Vivek Syiem.

The SIT concluded it as a suicide case and arrested many persons, including government officials for abetment to suicide.

Earlier, the high court had disposed of the petition on the ground that the SIT had filed the chargesheet.

However, unhappy with the SIT probe and not believing the suicide theory of the police, the mother had filed a petition in the supreme court for a CBI probe which has been pending.

A counsel who appeared for the case in the Supreme Court said that the matter was taken up on Monday and the apex court wanted the high court of Meghalaya to reexamine theĀ  petition.

The supreme court wanted the high court to hear the plea again, the counsel added.
