Section 144 CrPC only in counting area in Polo not whole EKH: DC

Shillong, May 31: East Khasi Hills Deputy Commissioner SC Sadhu said on Friday that section 144 CrPC will be applicable only in the counting area in Polo and not the entire East Khasi Hills District.

Sadhu told reporters ob Friday after meeting the political parties and the headmen that the meeting stressed the need of maintaining law and order during the victory procession on June 4.

“We have taken note of the concerns and therefore, we have taken a decision that point 5 of the 144 CrPC order which applied to the entire East Khasi Hills will be revoked and all other points in the order will remain the same,” Sadhu said.

The clause (v) had said, “No victory procession/rallies by any candidate/political parties after the declaration of result shall be permissible within East Khasi Hills District”. 

THE ORDER UNDER SECTION 144 Cr.P.C.

Whereas, the counting of votes for the General Elections to the Lok Sabha 2024 is fixed on the 4th June 2024.

And whereas; in order to maintain public peace, order and tranquility on the day of counting; I, Shri. S.C. Sadhu, IAS, District Magistrate, East Khasi Hills District, Shillong in exercise of the powers conferred upon me under section 144 Cr.P.C. do hereby prohibit as under: –

(1) Procession and Sloganeering of any kind shall not be allowed within the premises of the counting centre till completion of counting of votes and declaration of results.

(ii) Use of P.A. System/loudspeakers and celebration by any political party or candidates shall not be allowed within the premises of the counting venue.

(iii) Carrying of sticks either with or without flags, lathis, firearms, processions or big gatherings within a radius of one kilometre from the counting centre is also prohibited

(iv) Bursting and throwing crackers on the roads and at public places is strictly prohibited on the day of counting.

(v) No victory procession/rallies by any candidate/political parties after the declaration of result shall be permissible within East Khasi Hills District. (This clause  was revoked by DC)

(vi) Not more than two persons shall be allowed to accompany the winning candidate or his/her authorized representative to receive the certificate of election from the Returning Officer concerned.

(vii) In the premises of the Counting Hall, the following will apply:

(a) Only persons with valid ID cards/Car Pass issued by the District Election Officerг, East Khasi Hills District, shall be allowed to enter the premises.

(b) Mobile Phone and Cameras shall not be allowed to carry inside the counting hall. This order shall come into force with immediate effect and remain in force till 4.00 P.M of 6th June 2024.
