The bail application of Sonam will also be heard by the sessions court.

When contacted, Advocate Sujit Dey, who took up the case on behalf of the victim’s family, said the chargesheet has been filed against the accused Sonam for offences which are exclusively triable by the court of sessions.

After furnishing copies of the charge sheet and other documents to the accused under Section 230 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 207 CrPC), and upon hearing the parties, it appears that the case is beyond the jurisdiction of the court.

Accordingly, in exercise of powers under Section 232 BNSS (corresponding to Section 209 CrPC), the case was committed to the court of sessions here for trial in accordance with law.

The accused Sonam is presently in judicial custody.

“The question of bail is left open for consideration by th sessions court, Shillong. The case record, documents, and material exhibits will be transmitted to the court of sessions forthwith”, Dey added.
