Shillong, Sept 16: Congress leader Ronnie Lyngdoh has served a legal notice to Assembly Speaker Thomas Sangma on Monday seeking disqualification of its member Celestine Lyngdoh, who joined NPP.
Last Monday, a similar petition was filed before the Speaker seeking disqualification of MLAs- Gabriel Wahlang and Charles Marngar for joining NPP.
The petitioner wanted the Speaker to disqualify Celestine from the Meghalaya Legislative Assembly with immediate effect on account of having incurred defection as per Para 2(1)(a) of the Tenth Schedule of the Constitution of India.
The petitioner said he was constrained to file the disqualification petition in view of the brazen, illegal and unconstitutional acts of Celestine.
Celestine in connivance with 2 other MLAs have acted against the principles of the Constitution of India as well as the Party Constitution, the petitioner said.
“The Respondent ( Celestine) has thereby committed the constitutional sin of defection. Without the consent and approval of the INC, the Respondent has joined hands with the National People’s Party (NPP) and have tried to ‘merge’ INC with the NPP”, the petition said.
According to the petitioner, the Respondent has acted contrary to the directions and undisputed position of their ‘original political party’ and have voluntarily given up membership of the INC. Hence, the rigors under Paragraph 2(1)(a) of the Tenth Schedule appended to the Constitution of India are attracted and the Respondent MLA is liable to face disqualification”.
