Accused files counter FIR against woman in gangrape case, secures bail

Shillong, Apr 30: An accused, who had allegedly raped a woman along with three others, has filed a counter FIR against her for allegedly sexually assaulting him.

The incident took place in a rented house in Nongthymmai locality.

The accused, who was a minor when the crime was committed, secured bail from the district council court.

He was not arrested but only detained by the police after the woman narrated her ordeal last week about the incident in September last year after a video involving her surfaced recently. Three others involved and subsequently arrested have been identified as Modify Dkhar (20), Trustful Dkhar (20) and Emkilang Shyrmang (18).

They are the residents of Syrpoo-Sutnga in Khliehriat, East Jaintia Hills.

East Khasi Hills SP Rituraj Ravi said in a statement issued on Tuesday that regarding the “update in the matter of viral video/ gangrape case under Rynjah PS, one of the accused persons who was a minor/ juvenile at the time the crime was committed, has filed an FIR at Rynjah PS against the woman that he was sexually assaulted by her on that day. Accordingly, the FIR has been registered under POCSO Act and IPC and investigation is under progress”.

According to media reports, all the accused  sexually assaulted the woman and shot a video and released it online. Video clips were also circulated on WhatsApp.

The victim filed the FIR on April 20 after she came to know about the circulated video from one of her friends.

Media reports quoting the victim had said that she knew one of the accused since they used to play online games together.The accused invited her to his house and served her noodles and a soft drink.
“In good faith, I drank it. After around 45 minutes, I started to fall asleep. I requested him to drop me home. But he insisted that I rest there and he would drop me later. but when I woke up later, I did not suspect anything as my clothes were intact and I did not feel any pain or discomfort”, the victim was quoted as informing a local news channel.

“I knew that I had been gang-raped only after the video went viral,” she had said.
The victim filed an FIR at Nongthymmai beat house and the three accused were arrested.

What the fresh counter FIR said 

In his FIR, the accused person, who was a minor, claimed that he was 17 and a school student when the incident took place last year in their rented house. He accused the woman was known to him and his friends and she wanted to make youtube video of her gaming, songs etc and she used to tell him to share her videos with his school friends and she even visited their residence on a few occasions, however at no occasion has he shared her videos to any individual or any of his friends.

He said in September 2023, he was surprised to see the woman at their house where she had allegedly attempted to sexually assault him.

“I felt extremely harassed and humiliated at that time and the same had left me very shocked and surprised. However, since I was a student of class 10 at that time, I did not inform about the said incident to my parents or my teachers and elders thinking that I will be scolded and kicked out of school and my parents will stop my education. Recently, I came to learn that…(the woman) has lodged one FIR about the said incident showing that she was the victim, however I want to inform the actual facts of the incident and to say that I was sexually harassed by her when I was a class 10 student. However, I did not immediately lodge the FIR since I was threatened by her, and I was very scared of my parents and teachers that if any one comes to learn about the incident, it may tarnish the reputation of me and my family. As such, the delay is not intentional and may kindly be condoned. Moreover, an application under Section 438 CrPC was also filed by me before the court and an interim order was also passed in my favour. I, therefore, request you to take necessary action against her as per law and punish her,” he said in the FIR.
