
Shillong,Aug 30: An FIR was lodged against an Enforcement Directorate (ED) official here for allegedly assaulting a witness in a case in the GHADC.
According to the FIR lodged with the police in Nongmensong by Advocate Niksrang Marak on behalf of his client Sansilstone Sangma, there is a need to register the FIR against Shekar Kumar, the ED official, who, according to media reports, was previously linked to a bribery case in Kerala.
The FIR said that Sangma had appeared before the ED officer on August 27 pursuant to the summons issued to him for the purpose of recording his statement. Sangma attended the proceedings and cooperated with the investigation.
“That my client has specifically stated that he was not resisting or obstructing the questioning and that the alleged use of physical force was wholly unwarranted and disproportionate”, the advocate said
Following the assault, Sangma suffered pain and swelling/injury to his forearm/hand.
After the questioning was completed, he was taken to Civil Hospital, Shillong for medical examination and treatment.
The incident occured within the premises of the ED, where CCTV cameras are installed. The CCTV recordings of relevant room, corridor, entry and exit points, and surrounding areas are therefore crucial and material evidence, the FIR said.
“That the identity of all officers, staff and other persons present in or around the place of occurrence may kindly be ascertained and their statements recorded independently”, the FIR suggested.
That the fact that the alleged incident took place within the premises of a central agency, does not place the acts beyond the purview of criminal law. My client is entitled to protection of his bodily integrity and to a fair and impartial investigation into his complaint”, the advocate of the victim said in the FIR.
