Govt notifies extension of CrPC, CPC in all courts in state
Councils to derive powers under paragraphs 4 & 5 of the Sixth Schedule to the Constitution
Shillong, Sept 20: The government has notified extending CrPC and CPC to all courts in the state.
The notification issued by the Secretary in-charge Law department said the Governor is pleased to apply the provisions of the Code of Civil Procedure 1908 and provisions of the Code of Criminal Procedure, 1973 to the courts in the state of Meghalaya.
However, the District Council Courts will continue to derive powers under paragraphs 4 and 5 of the Sixth Schedule to the Constitution of India.
The notification said the governor further directs that, notwithstanding such application, all actions taken by the Courts throughout Meghalaya, under the Rules for the Administration of Justice and Police in the Khasi and Jaintia Hills, 1937 and the Rules of Administration of Justice and Police in Garo Hills, 1937 shall be deemed to have been taken under the relevant provisions of the Code of Civil Procedure, 1908 and relevant provisions of the Code of Criminal Procedure, 1973.
The autonomous district councils have already opposed the decision and wanted the government to exempt the district council courts from the notification.
