Shillong, Aug 4: Two KSU activists allegedly involved in the murder of two labourers in Ichamati and Dalda were granted bail by the lower court here.
The court of the judicial magistrate first class granted default bail to Mesadapbor Skhembil and Shanborlang Shati
Default bail is granted after 90 days of the arrest of the accused as the police did not file chargesheet within the same period.
The KSU activists were arrested on April 2 under section 302 IPC read with section 34 in connection the murder of labourers- Insan Singh and Sujit Dutta at Ichamati and Dalda respectively on March 27.
Police had arrested two more KSU members-Osternic Marbaniang and Cleanstar Shabong (27) in connection with the incident.
The court order on July 2 said Skhembil and Shati are to be released on furnishing and acceptance by the court, of bail bond of Rs 30,000 along with two reliable and sureties to the satisfaction of the court, each surety also being liable for a like amount. The accused persons are granted default bail subject to strict compliance with the following conditions.
(i) that the accused person shall not commit an offence similar to the offence which he is accused of in this case;
(ii)that he shall not make, directly or indirectly, any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them/such person from disclosing such facts to the court or to any police officer or to tamper with the evidence.
(iii) that he will appear before the court on each and every date fixed by the court;
(iv) that he will fully and wholly co-operate with the investigation being conducted by the police and shall appear before the investigating officer as and when directed by him.
(v) that he will not tamper with the evidence in any manner whatsoever.
(vi) that he will not hamper the investigation in any manner whatsoever.
8. The investigation officer is directed to inform this Court and take necessary steps for cancellation of bail should any of the above conditions be violated in any manner.
9.Accordingly, the accused persons are to be released as and when bail bonds are furnished to this Court and accepted by it and release notice is issued by the Court and if the accused is no longer required in custody with any other case.
