Interim stay on Lokayukta case against Boston

Shillong, June 6: High Court of Meghalaya has kept in abeyance the Lokayukta case against former CEM of GHADC Boston Marak, who was chargesheeted along with 12 others in an alleged corruption issue under GHADC.

The order of the court was on the same day on June 5  when the BJP state president Ernest Mawrie removed Boston from the post of president ST Morcha citing the chargesheet against him.

However, the lawyer of Boston said no court has framed charges against him and hence action against the BJP member at this juncture cannot be justified.

The lawyer pointed out that there are mny tainted BJP leaders against whom no action was taken while Boston was relieved of his post without issuing any notice to him.

According to Boston, the investigation officer of the case is yet to take his statement.

The petition was filed by advocate Sujit Dey on behalf of  the applicants/petitioners for an
interim stay of the order of Lokayukta issued on May 18.
The ground set out by the counsel was that the  order was passed without affording any opportunity of being heard and for
blatant violation of the principles of natural justice, particularly regarding the provision of Section 21 of the Meghalaya Lokayukta Act, 2014″,
The court said it also noticed that the respondents herein have not been
informed about the present proceedings.

The court wanted  to ensure that notice is duly issued upon the respondents.

“In the meantime, the impugned order dated 18.05.2023 is hereby kept in abeyance until the next date fixed.

The matter will come up for hearing after two weeks.
