Activist annoyed over police not registering case
Shillong, April 29: Social activist Tennydard Marak wanted the police to register a case against the alleged misleading and objectionable advertisements aimed at misguiding the voters by Marcuise N Marak and NPP ahead of the Assembly polls.
Marcuise, who won the Assembly seat from Williamnagar, is a minister in the MDA-2 cabinet.
The Officer in-Charge (OC) of Williamnagar police station, in a letter to Tennydard on April 28, refused to register a case in response to the FIR filed by him on March 23.
The OC said after preliminary inquiry, he found it to be an election petition and suggested to take up the matter with the returning officer as it pertains to model code violation.
The stand of the petitioner is that as per Section 154 (1) of the CrPC. a police officer is duty bound to register a case on the basis of such information disclosing a cognizable offence and FIR has to be registered irrespective of territorial jurisdiction.
The petitioner had filed a complaint petition before the Chief Election Commissioner of India on March 23.
Tennydard also moved the High Court of Meghalaya against Marcuise.
The matter came up for hearing on April 25.
The application was for seeking condonation of 4 days’ delay in filing the election petition.
A.Kumar, Advocate General assisted by A.Thungwa, government advocate on behalf of respondents wanted to file a short objection to the application.

The matter will come up for hearing on May 10 regarding the objection.
Tennydard alleged that Chief whip of Govt. of Meghalaya has not only misused his official power deliberately, which he is not supposed to, which is illegal , misguided the voter and the public in general and lowered the dignity of the political party , NPP by giving false/fake and fabricated advertisement by circulating the “Report Card – 2018-22” to win the Williamnagar seat, is nothing but an act amounts to criminal breach of trust, producing fake/false/fabricated evidence , cheating the public at large, applying fraudulent means for vested interest to woo the voters to win the seat by hook or by crook and was successful also.
