HC continues hearing on education scam case

Shillong, May 20: The High Court of Meghalaya continued its hearing on the education scam case on Tuesday.

During the hearing, Chief Justice LP Mukerji referred to the background stating that the criminal case arises from the selection and appointment of assistant teachers in Lower Primary Schools in 2008-09. The case was investigated by the Central Bureau of
Investigation (CBI). The charge against the accused is of subverting the
selection process by interpolating, forging or fabricating the examination result sheets to help specific candidates.
Applications under Section 482 of the Criminal Procedure Code now Bharatiya Nagarik Suraksha Sanhita (BNSS) have been made to the court by the three accused for quashing of the proceedings.

The prosecuting agency CBI has also made an application before the court complaining of the order passed by the criminal court.
In this proceeding, Salman Khurshid, senior
advocate has concluded arguments on behalf of the first accused, who is cabinet minister Ampareen Lyngdoh.

K. Paul, senior advocate has started arguments on behalf of the second accused, JD Sangma who was Director in the Department of School Education at that point of time.
On Tuesday, the counsel requested the court to allow filing compilation containing the specific charges which have been levelled
against his client out of the countless charges which have been included in the charge framed.  By this exercise, the counsel would try to demonstrate before the court that the charges are vague, uncertain and
do not point or disclose any offence against his client
The court said the compilation may be filed by June 4 .

The applications will be further considered on June 13 and all subsisting interim orders will  continue till disposal of the applications or until further orders, whichever is earlier.
